This document is reposted in this section of the forum as requested.

I’ve checked through the Hate Crime Consultation Paper (Hate Crime Final Report) looking for any possible points of interest as requested. The following are the points relating specifically to naturism. Almost every reference to naturism refers to it as a Philosophical Belief.

There is one section regarding ‘missiles’ being thrown at football matches and this is the only similarity I can find to compare with eggs being thrown at the WNBR. The relevant paragraphs are included below. I can do more searching for any other specific words or phrases if required. For example, I can recover all instances of verbal abuse if anybody considers it useful.

The enclosed PDF document is composed mainly of quotes from the Consultation Paper. Any text I have added will be shown in [Square Brackets] to distinguish it from the main document quotes. The page numbers refer to the actual page in the main document.

The consultation paper is massive, and I think is a warning that just about every group in the country will be preparing to be considered as a special case. So naturism had better present itself in a way that will appeal to the Law Commission's view of justice and logic. In this respect it doesn't help that their definition of naturism is "Naturism: The practice of going without clothes. " whereas most of the mentions later on refer to a "philosophical belief". There is the contrast between and act and a view of life. On the whole Human Rights legislation (which hate crime is derived from) tries to protect people from abuse arising from their innate characteristics, but not from their lifestyle choices. The Law Commission seem to consider naturism as a lifestyle choice, which may not be helpful. So we may need to address this issue in our submission.

Hate crime laws and Naturism- a balanced view.

I took to the idea of writing this essay as a balanced analysis between protection of individual expression and highlighting the dangers of  State controls that seek to limit freedom of expression.

In a true democracy Naturists, like everyone, should  be able to go about their activities as consenting adults without fear of police and public harassment. I am obviously supportive  of the idea of preventing abuse against Naturists in principle and practicality.  It doesn't stop there- a problem with any kind of prevention is it allows the State a green light to legislate further restrictions on liberty- a knee jerk reaction,  if you will. I've been monitoring the UK Government's recent miserable record- every current Bill being pushed in the Commons is about restricting freedom of expression,  as opposed to allowing and advancing democracy.  Paradoxically, unconsciously even , broad minded Naturists wouldn't want to contribute to such a scenario which may well create further resentment in the population.

Preventing hate is well and good,  so long as it doesn't reach the point where  constructive criticism in itself becomes a crime.  I witnessed first hand on last year's Clacton ride,   the beginnings of physical violence against the riders.  Fortunately it was averted and I felt we deescalated a potentially volatile situation.  It provides evidence that physical violence is always going to be far more damaging to health than the occasional expletive. This doesn't,  however,  justify virulent abuse of riders that can easily move into physical threats. Ir depends on what one interprets as 'Hate', and what one defines as 'crime.'To my mind,  Naturism is about the individual's right to be themselves,  while accepting there'll always be some objections.  If two opposing forces can co exist side by side,  that's 'Democracy At  Work.'

As an advocate  of freedom of speech and expression, I believe that nothing should be beyond criticism to a point where the very notion of objection becomes criminality.  'Freedom of speech and expression ' in themselves, should be protected by law.  Such would allow all and sundry to go about their lives without State intrusion and intimidation.   Believers of freedom should always be aware of the dangers of impending absolute State control. Every repressive law restricting freedom is a precursor for yet another repressive Bill.  To reiterate,  once again,  a written constitution including an First Amendment similar to that of the United States would protect liberties being eroded by the State.

It would be an irony of the high order if Naturism-  often described as the Canary in the coal mine of free expression- were to sleepwalk into a situation where protecting their own rights contributed to a State preventing the rights of others.

To a degree I agree with Adam on limiting freedom of expression. I have reservations over the whole concept of Hate Crime, which I will keep private while this consultation is taking place. To me a crime's seriousness depends on its effect on the victim, not the motive of the perpetrator (which is t best very hard to determine without thought reading powers). A crime is a crime and adding 'hate' to it doesn't affect the outcome of the crime IMHO. Seeking to make 'hate' illegal by making crimes motivate in this way punished more severely smacks a little of the Thought Police. I agree with people society being made not to harm each other, but I don't see it as right, or possible to stop people disagreeing, or even hating each other, any more than you can make people love each other by legislation. I am reminded of the old saying ;
" A man convinced against his will
  Is of the same opinion still."

These problems can be dealt with by existing legislation but experience tells us that they never are. The police have been known to show extreme bias against naturists. As a result, incidents against naturists are almost never pursued.

Having specific protection against hate crime would change all that. All of a sudden, the police will have to take naturists seriously and accept that there are two sides to an argument - not one.

In addition, all qualifying incidents would have to be officially recorded as hate crime. These records will help to show the real extent of the hate crime problem. Currently, no official records are being kept. This makes it look as if hate crime against naturists doesn't exist. But we know that it does exist and it needs to be addressed.

This doesn't mean that naturists will start playing the 'hate crime card' every time somebody shows disapproval! Just the opposite. Our biggest aim is to be accepted by other people. But we do need the scales to be balanced in order for naturists to be treated equally and fairly.
